These Terms & Conditions (“Terms”) govern the use of services and rental products provided by PopUpMasters (“we,” “our,” or “us”). By engaging our services, renting equipment, or using our website, you (“Client,” “you”) agree to these Terms.

1. Services Provided

PopUpMasters offers:

Design, fabrication, and construction services for pop-up shops, retail buildouts, and brand activations.
Rental services including pedestals, tables, chairs, shelving units, counters, rolling racks, wooden tables, hangers, changing rooms, modular walls, and other related fixtures and event equipment.

2. Quotes & Payments

All quotes are valid for 30 days unless otherwise specified.
A deposit (typically 50%) may be required to confirm bookings or projects.
Full payment must be made before delivery or completion unless otherwise agreed in writing.
Late payments may incur additional charges.

3. Rentals

Rental Period: The rental term begins upon delivery/pick-up and ends upon return/collection.
Condition of Items: All items are provided in good condition. Clients are responsible for the care of rented items.
Loss or Damage: Clients are liable for any damage, loss, or theft of rented items during the rental period. Repair or replacement costs will be charged.
Return of Items: Items must be returned in the same condition as received. Additional fees may apply for cleaning or repairs.

4. Delivery & Collection

Delivery and pickup services may be provided at an additional cost.
Clients must ensure access to the site is safe and suitable for delivery, installation, and collection.
Additional charges may apply for delays caused by site inaccessibility.

5. Cancellations & Refunds

Cancellations must be made in writing.
Design/Build Services: Deposits are non-refundable once project work has begun.
Rentals: Cancellations made less than 7 days before delivery may be subject to a cancellation fee (up to 100% of the rental cost).
Refunds, if applicable, will be processed within 14 business days.

6. Client Responsibilities

Provide accurate project information and requirements.
Obtain all necessary permits, licenses, or venue approvals (unless otherwise agreed).
Ensure safe working conditions for our staff and contractors.
Maintain rented items in good condition and use them only for their intended purpose.

7. Liability

PopUpMasters is not liable for any indirect, incidental, or consequential damages, including loss of profits, arising from the use of our services or rentals.
Our total liability is limited to the amount paid for the specific service or rental in question.
Clients are responsible for ensuring proper insurance coverage for events, merchandise, and use of rented equipment.

8. Intellectual Property

All designs, concepts, and creative work remain the property of PopUpMasters unless otherwise agreed in writing.
Clients may not reproduce, copy, or use PopUpMasters designs without prior consent.

9. Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, transportation delays, or government restrictions.

10. Termination

We reserve the right to terminate a contract or rental agreement immediately if:

Payment terms are not met.
Items are misused, damaged, or at risk.
Clients breach these Terms.

11. Governing Law

These Terms are governed by the laws of New York State (or insert your state/country). Any disputes will be resolved in the courts of that jurisdiction.
